Terms of ordering and delivery of floral arrangements

 

In accordance with the Trade Law, Article 17, Paragraph 3, Sotex Inc. has entered into an agreement with the company Pahuljica Flower Shop Belgrade, Registration Number: 64608339 (hereinafter referred to as the Flower Shop), allowing it to provide distance selling services through an electronic store (in the form of dropshipping e-commerce). By this agreement, the Flower Shop has consented to Sotex Inc. to use its name and identity for online sales. The website www.cvecarapahuljica.com (hereinafter referred to as the Sales Point) is owned by Sotex Inc., Delaware, USA (hereinafter referred to as the Seller).

 


Explanation of terms used in the text:

 

ORDER is the contractual relationship between the buyer (the individual who has ordered the goods and has made or committed to making payment) and the Seller, who has committed to delivering the sold goods to the recipient at the place and/or address designated by the buyer.

A VALID ORDER is when the buyer has made payment or committed to making payment and has provided the Seller with all necessary information required for the delivery.

The BUYER (PURCHASER) is the individual who has ordered the goods from the Seller.

The RECIPIENT is the individual designated by the buyer to receive the goods.

 

Order reception

 

The Seller accepts orders at the point of sale, by phone, or in writing via email (either directly written or sent through an online form located on the Sales Point).

The Buyer is obliged to provide the Seller with all relevant information necessary for successful and uninterrupted delivery, including the recipient's full name, exact delivery address, recipient's contact phone number, and any other pertinent details.

 

Delivery Deadlines and Terms

 

The Seller will deliver the ordered goods to the requested address as desired by the buyer, ensuring that the desired delivery time is respected.

The Seller reserves the right to adjust the delivery time by up to 60 minutes before and 60 minutes after the requested delivery time, based on their capabilities.

Flower delivery for funerals (to the cemetery, to the chapel from which the funeral procession departs) is carried out no later than one hour before the scheduled burial time.

 

Delivery

 

The Seller will deliver the ordered floral arrangement to the recipient's address.

The Buyer can also be the recipient if they are ordering flowers for themselves. Additionally, any other person at the recipient's address can also receive the flowers if they wish to do so.

The Seller will notify the Buyer about the completed delivery (via SMS, email, or phone call).

The Buyer is obliged to be available by phone during the indicated delivery time to be able to contact in case of any potential issues during delivery.

 

Delivery to hospitals, hotels, and offices:

For delivery to the mentioned institutions, additional information will be required: the exact name of the institution, address, phone number, room number, floor, etc.

Delivery to such places is considered completed when the ordered arrangement is received by the person responsible for receiving such shipments.

 

Execution of delivery

 

Delivery will be considered completed when the recipient or an authorized person at the recipient's address signs the delivery note.

The Seller will make every effort to complete the delivery, but in the four cases listed below, even if the delivery is not completed, it will be considered executed:

     * The recipient refuses to accept the shipment;

     * Incorrect recipient address or information;

     * The recipient is not at the specified address at the indicated time, and any present individuals (roommates, neighbors, colleagues) refuse to accept the floral arrangement;

     * Force majeure events that render the Seller unable to complete the delivery.

 

In the first three cases, we will inform the buyer about the situation. The buyer, if they wish, will be able to pick up the product at the Flower Shop at their own expense within 36 hours from the moment we notify them. If in this situation we cannot contact the buyer within 30 minutes, the delivery will be considered completed.

 

Complaints

 

The Seller will consider complaints regarding the delivered floral arrangement if reported within 1 hour after the delivery has been completed.

Complaints will be considered if the Seller has not fulfilled any contracted part of the order, if the wrong floral arrangement has been delivered, or if the delivery has been made to the wrong person or address.

The Seller undertakes to rectify any mentioned deficiencies as soon as possible.

 

Cancellation of order

 

Due to the potential for abuse, order cancellation is not possible.

 

Products (flowers and plant material)

 

Due to seasonal characteristics and the nature of plant material, the Seller cannot guarantee that the appearance of the product will be identical in all details to that shown in the accompanying image. The Seller will always strive for the incorporated elements to be identical to the photograph of the ordered arrangement, but in the interest of the buyer, the Seller reserves the right to replace one or more components in the product, always ensuring that the product still matches the description in style and quality.

The flowers in some pictures may be shown in full bloom. The Seller reserves the right to incorporate flowers in the bud stage into the ordered arrangement (thereby extending the duration of the floral arrangement).

 

Warnings and situations where the Seller does not assume responsibility for any damages incurred

 

The buyer should be aware that they are ordering a living product, and although the Seller guarantees the use of the highest quality plant material, the lifespan of the delivered products depends on the perishable nature of the plant material itself and the care provided by the recipient.

Some types of flowers and foliage may be toxic or cause skin rashes. It is necessary to keep these products out of reach of children and individuals with sensitive skin, and to wash hands after contact with flowers and foliage.

The pollen from the stamens of some flower species (such as lilies or anemones) can leave permanent stains on clothing. The recipient should take care to avoid touching clothing and furniture with these types of flowers.

Never leave flowers near electrical appliances, and always use some form of protective material between the plant containers and the surface on which they stand.

Some arrangements contain fruit, vegetables, candles, or other decorative items. None of the parts of the arrangement are intended for consumption. It is not advisable to light candles near flammable objects or leave them unattended when lit.

 

Statement on personal data protection and their use

 

The Seller undertakes to preserve the privacy of all its users.

The collected data necessary for the quality provision of service will be used exclusively for the purpose of fulfilling received orders and will not be provided to third parties.

All user data is strictly stored and accessible only to employees of the Seller who may use them solely for the purpose of providing the service to the buyer. All employees of the Seller and business partners are responsible for adhering to the principles of privacy protection.

By using the services of the Seller, you agree to the collection of personal data and their use for the stated purposes. If you do not want us to collect your personal data or do not agree with any part of this statement, please do not use the services of the Seller.

 

When ordering on the Sales Point, by phone, or via email, it is understood that the buyer is familiar with the above terms and fully agrees with them.
